AI in Irish Healthcare: Governance First, Technology Second

Healthcare AI in Ireland is moving faster than the governance frameworks supporting it. The organisations getting this right are building the governance infrastructure before they deploy the technology.

The pressure on Irish healthcare organisations to adopt AI is real and growing. Waiting lists, staff shortages, diagnostic backlogs, and administrative burden are all legitimate problems that AI has demonstrated an ability to reduce. The clinical and operational case for healthcare AI is not in doubt.

What is in doubt, in too many cases, is whether the governance infrastructure to support safe deployment is in place before the technology is switched on. In healthcare, the cost of getting that sequencing wrong is not a failed software project. It can be patient harm.

Why healthcare AI requires a different governance posture

AI in most business contexts is a productivity tool. A poor AI implementation in a distribution company or a professional services firm produces wasted money and frustrated staff. The same risk profile does not apply in healthcare.

An AI system influencing clinical decisions — diagnostic support, treatment recommendation, risk stratification, medication dosing — is operating in an environment where errors can cause direct, irreversible harm to patients. The governance requirements are proportionate to that risk, not to the scale of the organisation deploying the technology.

This is not an abstract principle. The EU AI Act, which is now in force and being enforced, classifies AI systems used in healthcare as high-risk under Annex III. High-risk classification triggers a substantial set of obligations: conformity assessment, registration in the EU database of high-risk AI systems, post-market monitoring, human oversight requirements, and transparency obligations. These apply to the deployer — the healthcare organisation — as well as to the developer of the system.

The HSE context

The HSE's AI strategy acknowledges the opportunity while emphasising the need for responsible deployment. The cyberattack in 2021 demonstrated the vulnerability of centralised healthcare IT infrastructure and has appropriately raised the governance threshold for new technology deployment. Any AI system deployed within HSE infrastructure inherits that governance context.

Private healthcare providers in Ireland — hospitals, diagnostics companies, GP networks, specialist clinics — are not subject to HSE governance frameworks, but they are subject to the EU AI Act, GDPR, and their professional regulatory obligations. The absence of a national governance framework does not mean an absence of governance obligations.

What HIQA considerations look like in practice

HIQA's remit covers the safety and quality of health and social care services. AI systems that affect clinical quality — including administrative AI that affects care pathway sequencing or resource allocation — fall within that scope. Organisations being inspected by HIQA that have deployed AI without documented governance frameworks, oversight mechanisms, and incident reporting procedures are exposed.

The practical question HIQA-regulated organisations should be asking is not "have we deployed AI safely?" but "how would we demonstrate to an external reviewer that our AI deployment is safe?" That framing tends to surface governance gaps that internal comfort with the technology obscures.

What governance first looks like in practice

A governance-first approach to healthcare AI starts with a risk classification exercise: what category of AI deployment is this, who does it affect, what are the failure modes, and what is the harm potential if it fails?

It then builds the oversight infrastructure before deployment: who reviews AI recommendations before they are acted on, how are errors recorded and escalated, who is responsible for monitoring ongoing AI performance, and what triggers a review or suspension of the system?

It includes staff training on AI limitations — not just on how to use the tool, but on where it is likely to be wrong and what appropriate scepticism looks like in clinical practice.

And it includes a documented audit trail: what the AI recommended, what the clinician decided, and where the two diverged. In a regulatory inquiry or litigation context, the absence of this audit trail is a serious governance failure.

None of this is technically complex. It requires time, clear ownership, and a board or leadership team that understands its obligations. The technology can wait while the governance is built. The governance cannot be retrofitted after a harm event.
