Why Most Legal AI Pilots Fail (And What to Do Instead)

Legal AI pilots stall not because the technology doesn't work but because the problem wasn't properly diagnosed before the tool was chosen. A different approach produces better results.

The pattern is consistent enough to have become predictable. A law firm — often prompted by a vendor demonstration or a news piece about competitor adoption — runs a pilot of an AI document review or research tool. Six months later, the pilot has produced some enthusiastic early adopters, a handful of sceptics, and no clear decision. The pilot is extended, quietly shelved, or replaced with a different tool and the same result.

The technology is rarely the reason these pilots fail.

Failure mode one: tool-first thinking

The most common error is selecting a tool before understanding the problem it is supposed to solve. "We should be using AI for document review" is not a diagnostic statement. It is a conclusion reached before the analysis.

Useful questions that precede tool selection: Which tasks in document review are genuinely creating bottlenecks? Are those bottlenecks caused by volume, by the complexity of the judgements required, by the skill level of the fee earners involved, or by something upstream in how matters are scoped? Which of those causes is AI actually capable of addressing, and which requires a different intervention?

In many cases, the answer is that the firm has a workflow problem and an AI tool applied to a broken workflow will produce faster, more consistent errors.

Failure mode two: no workflow diagnosis

Related to the above, but distinct. Even when the problem is genuine and AI-addressable, pilots fail when the tool is dropped into an existing workflow without redesigning the workflow around it. Document review AI does not slot into a process designed for manual review. It changes the nature of the task. The fee earner is no longer reading documents — they are validating and interrogating the AI's output. That is a different skill, and it requires a different process, different supervision structure, and different quality assurance.

Firms that run pilots without workflow redesign typically find that fee earners use the tool inconsistently, that quality control becomes harder rather than easier, and that the efficiency gains promised in the vendor demonstration do not materialise.

Failure mode three: inadequate change management

Legal practice is conservative for reasons that are not irrational. Solicitors carry personal professional responsibility for the advice they give. Introducing AI into that context without addressing the professional anxiety it creates — about quality, about liability, about what the tool actually does and does not do — produces resistance that no amount of mandating will overcome.

Change management in a legal AI pilot means involving fee earners in tool selection, communicating clearly about what the AI does and where human judgement remains essential, and giving people room to develop confidence before the tool is used on client-critical work. Firms that skip this find that nominal adoption rates mask actual non-use.

Failure mode four: governance gaps

Pilots that proceed without addressing data governance, professional privilege implications, or EU AI Act compliance are creating a problem they will have to unwind. When the pilot moves to production, those gaps become visible — to clients, to insurers, or to regulators. Retrofitting governance after a tool has been embedded in client-facing work is harder and more disruptive than building it in from the start.

What a successful legal AI pilot looks like

Start with a diagnostic. Identify the specific task where the pain is real, the volume justifies it, and the AI capability is genuinely relevant. Design or redesign the workflow before selecting the tool. Involve the people who will use it. Address governance before going live, not after. Set clear metrics for what success means — not adoption rate, but business outcome.

This approach takes longer than downloading a trial licence and letting people experiment. It also produces a pilot with a decision at the end of it.
